F.S. 757.04(1) which states,

"Whoever, without lawful authority, knowingly or recklessly takes or entices, or aids, abets, hires, or otherwise procures another to take or entice, any child 17 years or under or any incompetent person from the custody of his parent, his guardian, a public agency having the lawful charge of the child or incompetent person, or any other lawful custodian commits the offense of interference with custody and shall be guilty of a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 75.084."

F.S. 827.04(2), which states,

"Whoever, knowingly, or by culpable negligence, permits mental injury to a child, shall be guilty of a felony of the third degree, punishable as provided in S. 775.082, S. 775.083, or 775.084."

F.S. 61.13, section 1, sub-section 3, paragraph (b) - which states,

"It is the public policy of this state to assure each minor child frequent and continuing contact with both parents, after the parents have separated, or dissolved their marriage, and to encourage parents to share the rights and responsibilities of child rearing. Upon considering all relevant factors, the father of the child shall be given the same consideration as the mother in determining custody, regardless of the age of the child."

F.S. 61.13, section 3, sub-section 3, paragraphs (a) and (b), which state,

"For purposes of shared parental responsibility, and primary physical residence, the best interests of the child shall be determined by the court's consideration and evaluation of all factors affecting the best welfare and interests of the child, including, but not limited to, (a) The parent who is more likely to allow the child frequent and continuing contact with the non residential parent. (b) The love, affection, and other emotional ties existing between the parents and child."
